FREQUENTLY ASKED QUESTIONS

  • Notary Public: Can administer oaths, take affidavits, certify true copies of documents, and witness signatures. Notaries have broader authority, including certifying documents for use outside Ontario.
  • Commissioner of Oaths: Can only administer oaths and take affidavits or statutory declarations for use within Ontario. Cannot certify true copies or documents for use outside the province.
  • Notarization: Required for certified true copies, documents for use outside Ontario, some real estate transactions, and certain legal documents.
  • Commissioning: Required for affidavits, statutory declarations, and some government forms (e.g., vehicle transfers, pension forms).

Valid, government-issued photo identification (e.g., driver’s licence, passport) is required for both notarization and commissioning.

As of now, remote or virtual notarization is not permitted in Ontario, except for certain commissioning of oaths via video conference (e.g., during pandemic measures). Notarizations over the phone are not allowed.

No. Unless the notary is also a lawyer and retained for legal advice, notaries do not provide legal advice or draft legal documents.

The deponent must appear in person, present valid ID, swear or affirm the truth of the document, and sign in the presence of the commissioner or notary.

Only if the notary is fluent in the language or a certified translation is provided.

A photocopy of an original document that a notary public certifies as a true and accurate copy of the original.
