FREQUENTLY ASKED QUESTIONS
What is a will?
A will is a legal document that sets out how a person’s property and assets are to be distributed after death. It can also appoint guardians for minor children and name an executor (estate trustee) to manage the estate.
Who can make a will?
Anyone 18 or older who is mentally capable. There are exceptions for those under 18 in specific circumstances (e.g., married, member of the armed forces).
What happens if someone dies without a will?
The estate is distributed according to Ontario’s intestacy laws, which may not reflect the deceased’s wishes. The court appoints an estate trustee.
How do you make a valid will?
A will must be in writing, signed by the testator in the presence of two witnesses (who are not beneficiaries or their spouses), and signed by the witnesses. Holograph (handwritten) wills are also valid if entirely in the testator’s handwriting and signed.
What is a power of attorney?
A POA is a legal document that gives someone else the authority to make decisions on your behalf. In Ontario, there are two main types:
- Continuing Power of Attorney for Property: For financial matters, effective even if the grantor becomes mentally incapable.
- Power of Attorney for Personal Care: For health and personal care decisions if the grantor becomes incapable.
Is a power of attorney the same as a will?
No. A power of attorney is only valid while the grantor is alive and ceases upon death. A will only takes effect after death.
Who can be appointed as attorney?
Anyone 18 or older for property, and 16 or older for personal care, who is mentally capable.
Does a power of attorney need to be registered?
No, but it must be properly executed and witnessed.
Can a power of attorney be revoked?
Yes, as long as the grantor is mentally capable, by a written and witnessed revocation.
What is probate?
Probate is the court process that confirms the validity of a will and authorizes the executor to administer the estate.
Is probate always required?
Not always. Probate is generally required if the estate includes real property or if financial institutions require it to release assets.
What are probate fees?
Ontario charges an Estate Administration Tax based on the value of the estate.
