A will is a legal document that sets out how a person’s property and assets are to be distributed after death. It can also appoint guardians for minor children and name an executor (estate trustee) to manage the estate.

Anyone 18 or older who is mentally capable. There are exceptions for those under 18 in specific circumstances (e.g., married, member of the armed forces).

The estate is distributed according to Ontario’s intestacy laws, which may not reflect the deceased’s wishes. The court appoints an estate trustee.
